01Who publishes this site and the client portal

The website investirpourgagner.ca and the client portal attached to it (investirpourgagner.ca/portail) are published by Investir pour gagner (IPG), the brand under which Xavier Bélanger, Tristan Lemire, Raphaël Hébert-Bilodeau and Antoine Ménard offer their real estate brokerage and investment analysis services in Quebec.

The site and the portal are hosted by GoDaddy (Web Hosting), whose servers are located in North America.

02Real estate brokerage and oversight

Brokerage services are provided by brokers licensed by the Organisme d'autoréglementation du courtage immobilier du Québec (OACIQ), practising within eXp agence immobilière. They are subject to the Real Estate Brokerage Act and its regulations, including the brokers' code of ethics, and covered by the Quebec real estate brokerage professional liability insurance fund.

The OACIQ (oaciq.com) handles public requests for assistance and complaints about brokers. Investir pour gagner is neither a real estate agency nor a separate legal entity: each broker is answerable for their own professional acts.

03Nature of the information and no advice

The content of the site (texts, profitability calculator, simulations, worked examples, answers to frequent questions) is provided for general information only. It is not financial, legal, tax, accounting or investment advice, not a personalized recommendation and not a guarantee of return. The calculator and simulations rely on simplified assumptions and on the values you enter; their results have no appraisal value.

In the client portal, property listings ("deals") and their documents come from sellers, their brokers, real estate databases or public sources. They are shared so that a client can gauge their interest. They are neither an offer, nor a promise of sale, nor a guarantee of accuracy: income, expenses, number of units, areas, year of construction and asking price must be verified by the client before any decision, in particular through due diligence (inspection, financial statements, leases, certificate of location, title, municipal compliance) and with the support of the appropriate professionals.

Some listings are pre-filled from documents by an automated extraction tool, then reviewed by a broker before publication. Despite that review, a reading or transcription error remains possible: where a listing and its source document differ, the source document prevails.

04Terms of use of the client portal

The client portal is a private space reserved for clients of Investir pour gagner. Access is created by a broker, never by self-registration. By using it, you agree to the following:

• Personal credentials. Your email, password and one-time codes are strictly personal. You are responsible for keeping them safe; notify us without delay at info@investirpourgagner.ca if you believe they have been compromised.
• Confidentiality of listings and documents. The listings, figures and documents made available to you (presentations, rent rolls, financial statements, reports) are confidential and for your personal use only, to evaluate an investment opportunity. Copying, forwarding, publishing or disclosing them to third parties, in whole or in part, without written authorization is prohibited. Off-market properties are further subject to a confidentiality agreement that you must have signed before accessing them; that agreement applies in addition to these terms.
• Fair use. You may not use the portal to contact a seller or tenant directly about a property presented, to bypass the broker, to extract data by automated means, to attempt to access another person's account or to interfere with the service.
• Logging. Logins, listing views and document openings are logged (date, time, IP address, device) for the security of the service, proof of access and better follow-up by your broker. See the privacy policy.
• Suspension and closure. We may suspend or close an account in case of breach of these terms, at the end of the business relationship or at your request, without notice where security requires it.
• Availability. The portal is provided as is. We aim for continuous availability without guaranteeing it; an interruption for maintenance, outage or incident gives no right to compensation.

05Intellectual property

The entire site and portal are protected by the Copyright Act (Canada) and are the exclusive property of Investir pour gagner or its licensors: texts, images, photographs, logos, graphic elements, illustrations, calculator, simulations, code, structure, layout, database and visual identity, without exception.

Any reproduction, copy, extraction, capture, download, modification, distribution, publication or reuse, in whole or in part, of any element, on any medium and for any purpose, is strictly prohibited without our prior written authorization. This includes reusing texts or images on another site, imitating the structure or visual identity, training automated systems on our content and automated content extraction (scraping).

Documents made available in the portal (presentations, financial statements, reports, property photographs) remain the property of their authors or of the sellers who supplied them; they are shared with you solely to evaluate an investment opportunity, within the limits of section 4.

Any unauthorized use infringes our rights and may give rise to the appropriate remedies, including civil proceedings and damages. Third-party trademarks, including eXp, Centris and Google, belong to their respective owners. Authorization requests: info@investirpourgagner.ca.

06Limitation of liability

We strive to keep the information on the site and portal accurate and current, without being able to guarantee it. Information may be changed or removed without notice.

To the fullest extent permitted by law, Investir pour gagner and its member brokers cannot be held liable for direct or indirect damages (loss of profit, missed opportunity, loss of data, costs) arising from the use of the site, the portal or their content, from a decision made in reliance on that content, from a service interruption, from a security incident beyond reasonable control or from the content of third-party sites we link to. Nothing in this notice limits liability that cannot be excluded under applicable law, including the Consumer Protection Act and the Real Estate Brokerage Act.

Links to third-party sites (Centris, OACIQ, scheduling tools, social networks) are provided for your convenience; we have no control over those sites and do not endorse their content.

07Governing law

The site, the portal and this notice are governed by the laws applicable in Quebec and the federal laws of Canada applicable therein. Any dispute relating to their use falls under the jurisdiction of the competent courts of Quebec, subject to the rights the law grants you as a consumer. If a provision of this notice is found invalid, the others continue to apply. This English version is provided for convenience; in case of discrepancy, the French version prevails.

08Changes and contact

We may change this notice at any time; the dated online version prevails. Significant changes affecting the portal are announced to clients by email or at their next login.
